 1. Broker/Agent Responsibilities

Broker/Agent agrees to:

  1. Professional Service: Handle all referrals and leads with integrity and professionalism, ensuring compliance with all applicable laws, industry regulations, and ethical standards.

  2. Licensing Updates: Notify Realty Rush of any changes to licensing status within ten (10) business days.

  3. Accurate Reporting: Provide timely and accurate updates on the status of referrals and leads as requested by Realty Rush to maintain efficient lead tracking.

  4. Lead Management: Receive 3-5 leads per month (or more, depending on subscription level and area exclusivity). Leads will include buyer and/or seller referrals based on selected package preferences.

2. Payment and Compensation

Monthly Membership Fee

The subscription fee includes:

  • Exclusive, verified leads.
  • Geo-targeted marketing campaigns tailored to specific areas.
  • Personalized ad campaigns and priority lead forwarding.

Commission Terms

  1. Subscription Fee:
    Broker/Agent agrees to pay a monthly subscription fee ranging from $200 to $250, depending on the selected zip code(s) and exclusivity level.

  2. Commission Payment:
    Broker/Agent agrees to pay Realty Rush 10% of the gross profit for any real estate transaction (buying, selling, or renting) completed through Realty Rush leads.

Payment Timeline

  • Subscription fees are due monthly and are non-refundable.
  • Commission payments must be remitted within thirty (30) days of the transaction’s closing.

3. Lead Provision

Leads are allocated based on the zip codes selected by the Broker/Agent upon subscription.

  • Realty Rush ensures all leads are exclusive and geo-targeted but does not guarantee a specific number of leads per month.

 4. Refund Policy

Subscription Refunds:

  • Partial refunds are not provided for months with unused leads.

General Provisions

  1. Force Majeure
    Neither Party shall be held liable for delays or failures resulting from causes beyond their reasonable control, including but not limited to natural disasters, government actions, or unforeseen events.

  2. Governing Law
    This Agreement shall be governed by and construed in accordance with the laws of the state of New York. Any disputes arising under this Agreement shall be resolved exclusively within the jurisdiction of New York.

  3. Termination
    Broker/Agent may terminate their participation at any time but will remain obligated to pay the 10% commission on deals closed using Realty Rush leads.

  4. Confidentiality
    Realty Rush will not share Broker/Agent’s personal or professional details with third parties, ensuring protection against unsolicited communication.

  5. Communication
    After successful onboarding, Broker/Agent must respond to account manager communications within 24-48 hours to maintain access to priority services.
